This End User License Agreement (“Agreement” or “EULA”) is a legally binding agreement between you (“You”, “User”) and Tsamai (“Tsamai”, “Licensor”, “Application Provider”, “we”, “us”, or “our”) governing your use of the Tsamai mobile application(s), software, and related services (collectively, the “Product”).

The Product is made available exclusively through Apple Inc.’s software distribution platform (“Apple App Store”) and Google LLC’s software distribution platform (“Google Play Store”) (together, the “Services”).

BY DOWNLOADING, INSTALLING, ACCESSING, OR USING THE PRODUCT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT INSTALL OR USE THE PRODUCT.

1. Parties

This Agreement is entered into solely between you and Tsamai. Apple Inc., Google LLC, and their affiliates are not parties to this Agreement and bear no responsibility for the Product or its content.

2. Consent to Use of Data

You agree that Tsamai may collect, process, and use technical data and related information, including but not limited to device identifiers, operating system information, application performance data, and diagnostic data, to:

  • Operate, secure, and maintain the Product
  • Provide updates, support, and enhancements
  • Prevent fraud and abuse
  • Comply with legal and regulatory obligations

All data processing is governed by our Privacy Policy. Where required by law, data will be anonymised or aggregated.

 


3. License Grant

Subject to your compliance with this Agreement, Tsamai grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Product solely for your personal or internal business use on devices that you own or control, in accordance with applicable App Store usage rules.

All rights not expressly granted are reserved by Tsamai.

4. Restrictions

You may not:

  • Copy, modify, or create derivative works of the Product
  • Reverse engineer, decompile, or disassemble the Product except where prohibited by law
  • Rent, lease, sell, sublicense, or redistribute the Product
  • Use the Product for unlawful, fraudulent, or abusive purposes
  • Interfere with the security or integrity of the Product.


5. Age & Eligibility

You must be at least 13 years old to use the Product. If you are under 16, you must have consent from a parent or legal guardian.

Tsamai reserves the right to suspend or terminate access if eligibility requirements are not met.

6. User Content & Objectionable Content

Users may submit content through the Product. Tsamai reserves the right to monitor, moderate, remove, or restrict access to content at its sole discretion.

Prohibited content includes but is not limited to:

  • Sexually explicit, obscene, or pornographic content
  • Hate speech, harassment, or violent material
  • Fraudulent or misleading content
  • Content violating intellectual property or privacy rights
  • Illegal goods, services, gambling, or weapons.


7. Termination

This Agreement remains effective until terminated. Tsamai may terminate this Agreement immediately if you violate any provision.

Upon termination, all rights granted to you cease immediately, and you must delete the Product from all devices.


8. Disclaimer of Warranties

THE PRODUCT IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TSAMAI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.


9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TSAMAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM OR RELATED TO YOUR USE OF THE PRODUCT.

TSAMAI’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID (IF ANY) TO USE THE PRODUCT IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Tsamai from any claims, damages, losses, and expenses arising from your use of the Product or violation of this Agreement.

11. Compliance With Laws

You agree to comply with all applicable laws, regulations, and third-party terms when using the Product, including financial and export control laws.


12. Export Restrictions

You may not use or export the Product in violation of applicable export control laws or sanctions.

13. Third-Party Beneficiaries

Apple and Google are third-party beneficiaries of this Agreement and have the right to enforce it against you.

14. Governing Law

This Agreement shall be governed by applicable laws without regard to conflict of law principles.

15. Entire Agreement

This Agreement constitutes the entire agreement between you and Tsamai and supersedes all prior agreements relating to the Product.

16. Severability & Waiver

If any provision is found unenforceable, the remaining provisions remain in effect. Failure to enforce any right shall not constitute a waiver.

17. Assignment

You may not assign this Agreement without Tsamai’s consent. Tsamai may assign this Agreement freely.

18. Force Majeure

Tsamai shall not be liable for failure or delay due to events beyond its reasonable control.
